1. Acceptance of Terms
By accessing or using Hilior Analytics ("Hilior", "the Platform", "we", "us", or "our") at hillor.com, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and Madquick Pvt. Ltd., the company that owns and operates Hilior.
If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using Hilior, you represent and warrant that:
- You are at least 18 years old.
- •You have the legal capacity to enter into a binding agreement.
- •Your use of the Platform does not violate any applicable law or regulation.
- •If you are using the Platform on behalf of a business, you have authority to bind that business to these Terms.
3. Your Account
To access most features of Hilior, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- •Maintain the security of your password and not share it with others.
- •Notify us immediately at support@hillor.com if you suspect unauthorised access to your account.
- •Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
4. Description of Services
Hilior Analytics provides market intelligence data for the Flipkart e-commerce platform, including but not limited to:
- Product search, browsing, and detailed product pages.
- •Price tracking and price history charts.
- •Brand and category analytics.
- •Best Performing Products and Best Sellers identification.
- •Competitor and market analysis tools.
- •API access (Enterprise plan only).
We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.
5. Subscription Plans & Payment
Hilior offers both a Free plan and paid subscription plans (Pro and Agency). By subscribing to a paid plan:
- You authorise us to charge your chosen payment method via Razorpay on a recurring basis (monthly or annually) until you cancel.
- •Subscription fees are charged in Indian Rupees (INR) and are non-refundable except as stated in our 7-day refund policy for first-time paid subscribers.
- •All prices are exclusive of applicable taxes. GST or other applicable taxes will be added at checkout as required by Indian law.
- •We reserve the right to change subscription pricing with at least 30 days' notice. Price changes take effect at your next billing cycle.
- •Failure to pay may result in suspension or downgrade of your account to the Free plan.
6. Refund Policy
First-time paid subscribers may request a full refund within 7 days of their initial payment by contacting support@hillor.com. After this 7-day window, no refunds are issued for the current billing period.
Refunds are not available for:
- •Renewals of existing subscriptions.
- •Partial months or unused features within a billing period.
- •Accounts found to have violated these Terms.
Approved refunds are processed within 5–10 business days to your original payment method.
7. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
- Scrape, crawl, or systematically download data from the Platform using automated tools without our written permission.
- •Use the Platform to build a competing product or service.
- •Attempt to gain unauthorised access to any part of the Platform or its underlying infrastructure.
- •Reverse engineer, decompile, or disassemble any part of the Platform.
- •Use the Platform to transmit spam, malware, or any harmful content.
- •Misrepresent your identity or affiliation when using the Platform.
- •Resell, sublicense, or redistribute data from the Platform without prior written consent.
- •Interfere with or disrupt the integrity or performance of the Platform.
Violation of these rules may result in immediate account termination without refund.
8. Intellectual Property
All content on the Platform — including the software, design, text, graphics, logos, and data compilations — is the property of Madquick Pvt. Ltd. or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for your own internal business purposes. This licence does not include:
- Any resale or commercial redistribution of Platform content or data.
- •Any derivative use of the Platform or its content.
- •Any use of data mining or similar tools without our express written consent.
"Hilior" and related marks are trademarks of Madquick Pvt. Ltd. You may not use these marks without our prior written permission.
9. Data & Accuracy
The product data, prices, ratings, and other information on Hilior are collected from publicly available sources and updated regularly. However:
- Hilior is not affiliated with Flipkart or Walmart Inc.
- •We do not guarantee the accuracy, completeness, or timeliness of any data on the Platform.
- •Prices and product information may differ from what is currently shown on Flipkart.
- •You should independently verify any data before making business decisions.
We are not liable for any losses resulting from reliance on data provided by the Platform.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that any defects will be corrected or that the Platform or the servers that make it available are free of viruses or other harmful components.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Madquick Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from:
- Your use of or inability to use the Platform.
- •Any errors or inaccuracies in Platform data.
- •Unauthorised access to or alteration of your data.
- •Any third-party conduct or content on or linked from the Platform.
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 3 months preceding the claim.
12. Third-Party Services
The Platform integrates with third-party services including Razorpay for payment processing. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
The Platform may contain links to external websites. These links are provided for convenience only and do not imply endorsement. We have no control over and assume no responsibility for the content or privacy practices of any external sites.
13. Termination
You may stop using the Platform and cancel your account at any time by going to Profile → Subscription or by contacting support@hillor.com.
We may suspend or terminate your account immediately and without prior notice if we believe you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. Upon termination, your right to use the Platform ceases immediately.
Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — will survive.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
